Former Fitness Trainer Files Class Action Unpaid Overtime Lawsuit Against XSport

SPRINGFIELD, IL — A former trainer for XSport Fitness Inc. recently filed a class action unpaid overtime lawsuit against the company over allegations that the defendant failed to properly pay him and other trainers all their due wages, including overtime pay. The lawsuit claims that XSport routinely failed to pay its trainers all their proper wages and violated several provisions of both state and federal labor and wage laws.

According to the unpaid overtime lawsuit, filed in U.S. District Court in Illinois, the Fair Labor Standards Act, the Illinois Minimum Wage Law and the Illinois Wage Payment and Collection Act by paying trainers an annual salary of $23,600 while requiring them to work a minimum of 55 hours per week. The lawsuit claims that the plaintiff emailed his supervisors several times over concerns that he was not receiving all his due overtime wages, but those concerns were ignored.

Under the Fair Labor Standards Act (FLSA), which sets national standards for minimum wage and overtime pay, companies must pay their workers at least one and a half times the individual’s average hourly rate of pay when working above the 40-hour per week overtime threshold. Furthermore, businesses must provide workers with accurate payroll statements detailing all of their employees’ hours worked and wages earned.

Despite these clear laws, some companies attempt to classify certain workers as “overtime exempt” by classifying them as managers or other titles and paying them a flat, weekly salary regardless of how many hours these employees work. While the FLSA does allow certain types of workers to be paid salaries, the FLSA is clear on the types of duties these employees are expected to perform in the course of their day-to-day activities.
