United Cerebral Palsy Agrees to Settle Unpaid Overtime Lawsuit

PITTSBURG, PA — United Cerebral Palsy of South Central Pennsylvania Inc. recently agreed to settle an unpaid overtime lawsuit and resolve claims the advocacy group failed to properly pay one of its workers for all their hours worked. Under the terms of the settlement, United Cerebral Palsy will pay a combined $65,000 to pay the plaintiff who worked as an attendant manager and program coordinator and frequently put in more than 40 hours in a week without overtime.

According to the unpaid overtime lawsuit, filed in U.S. District Court for the Middle District of Pennsylvania, the plaintiff was essentially forced to remain on call 24 hours a day and work at her position without any overtime pay. The plaintiff claimed that the defendant improperly classified her as “overtime exempt” and therefore should have paid her one and a half times her average hourly rate of pay when working more than 40 hours per week as required under the federal Fair Labor Standards Act (FLSA).

The case is an example of the lengths some employers will go to keep overhead down at the expense of those working for the company who are trying to earn a living for themselves and provide for their families. The FLSA does allow certain classes of workers to be paid flat salaries without overtime, regardless of how many hours they work. However, these employees are expected to perform certain duties depending on their particular classification to be overtime exempt and work whatever hours are necessary to perform the job.

While the terms of the settlement do not require United Cerebral Palsy to admit fault for improperly classifying the plaintiff as overtime-exempt, the result is none the less important to ensuring companies follow the law and compensate workers appropriate properly under the law.
