Orlando Management Company Settles Wage Theft Allegations with Hundreds of Employees

ORLANDO, FL — A Florida management company recently agreed to settle claims with the U.S. Department of Labor on behalf of hundreds of employees whom the government claims were victims of rampant wage theft. As part of the consent decree, Orlando-based Vistana Management Inc. agreed to pay back 275 current and former workers a combined $372,183 in back wages, interest, and damages equal to back pay and further agreed to pay $41,368 in penalties for breaking federal law.

An investigation by the Labor Department’s Wage and Hour Division determined Vistana Management Inc. routinely altered payroll records to avoid paying workers all their due wages, including overtime pay when working more than 40 hours in a week. According to the Wage and Hour Division, managers from Vistana Management forced workers to sign documents allowing supervisors to alter time cards, change clock-in and clock-out times, and modify records to show workers took lunch breaks when in reality, these employees worked through their rest period.

“The resolution of this case puts these wages into the hands of those who earned them, and demonstrates how the Department of Labor’s enforcement protects workers and levels the playing field for law-abiding employers,” said District Director for the Wage and Hour Division Daniel White, in Jacksonville. “We encourage employers to contact the Wage and Hour Division in person, by phone, or online for assistance and to learn more about their responsibilities under the law.”

Under the Fair Labor Standards Act (FLSA), employers must pay their workers one and a half times the individual’s average hourly rate of pay when working more than 40 hours in a week and must provide accurate payroll records reflecting all hours worked. When companies break the law, wage theft victims have the legal right to file lawsuits in federal court to hold their employer responsible and recover all their back wages with interest, liquidated damages equal to unpaid income, and attorneys fees to cover the cost of litigation.
