What are the laws for a licensed practical nurse (LPN) overtime pay?

There are two laws for a licensed practical nurse (LPN) overtime pay – the Fair Labor Standard Act and State Law.  Under the FLSA law, overtime pay may be required when a licensed practical nurse works longer than 40 hours within seven consecutive days.  Often times, nurses will work long 12 hour shifts and adding a full or partial shift in one week can put them over the limit.

In addition the FLSA, some states have their overtime pay laws that differ slightly than the FLSA.  Some states have enacted overtime laws with respect to the number of hours an employee can work within a 24-hour span before receiving overtime pay.  Depending on the state in which you work in as a LPN will also determine when you receive overtime pay.

The failure of an employer to pay required overtime pay can give rise to a Licensed Practical Nurse overtime pay lawsuit.  These lawsuits are often filed by an entire group of nurses against a hospital or medical facility for payment of back overtime wages.  To determine whether you are eligible for filing a wage claim, call our experienced lawyers now at (855) 794-2795.  We offer a free, no obligation consultation and will represent you under r our No Win No Fee Promise which means no legal fees whatsoever until we win or settle your case.
