Utopia Home Care, Inc. Sued for Allegedly Violating the Fair Labor Standards Act and the New York Minimum Wage Act.

ISLIP, N.Y. — A home health care worker filed suit against Utopia Home Care, Inc. in the United States District Court, Eastern District of New York alleging that Utopia failed to pay her the wages she earned in violation of both the Fair Labor Standards Act and the New York Minimum Wage Act. Specifically, she alleges that Utopia failed to follow the FLSA’s companionship exemption when she spent more than 20 percent of her time doing general household work as part of providing companionship services to the patient. Shenithia Cowell seeks to represent a potent class of more than 1,000 employees in the case entitled, Shenithia Cowell v. Utopia Home Care, Inc, No. 14-cv-00736.

Utopia, a New York based company with 22 locations in six different states, provides nurses, therapists, social workers, home health aides, personal care aids, live-in aides and homemakers for patients in need of those services.
