CHICAGO — On August 28, 2013, lawyers filed a nationwide class action lawsuit against TMX Finance, LLC and TitleMax of Illinois, Inc. on behalf of current and former General Managers in Training (“GMIT”) who worked at TitleMax locations across the United States.
The employees allege that TitleMax violated the federal Fair Labor Standards Act (FLSA) and similar state labor laws by misclassifying them as salaried exempt and requiring them to work excessive overtime hours for which they were never compensated.
Employees also allege that, in early 2013, TitleMax admitted it violated the law when it re-classified its GMITs as hourly non-exempt employees without changing their job duties and without paying them for past overtime worked. The lawsuit is currently pending in the U.S. District Court, Northern District of Illinois, and attorneys currently interviewing current and former GMITs from across the country.
