Luxury Hotel Workers Sue Starwood In Overtime Lawsuit

Calif. — An unpaid overtime lawsuit was recently filed by luxury hotel workers of the W Hollywood Hotel in Los Angeles against Starwood Hotels & Resorts Worldwide Inc. and Sheraton Operating Co.   The lawsuit alleges that the hotel failed to pay them overtime wages for meal and rest breaks.  This includes allegations that the luxury hotel violated federal wage laws and committed multiple violations of the California Labor Code by failing to pay nonexempt W Hollywood employees for all hours worked, which included proper meal and rest breaks.

According to the complaint, the defendants required housekeepers, welcome staff, and food and beverage workers to work periods of more than four hours without a rest break and more than five hours without a meal break, and never sought a written Starwood Unpaid Overtime Lawsuitwaiver of meal breaks from the employees. Furthermore, hotel managers required those employees to work more than eight hours a day or more than 40 hours a week without paying time and a half, the plaintiffs claim.

During both rest and meal breaks, the employees were required to carry radios so they were accessible to customers and management.  If called, an employee had to immediately end a break and return to work, the suit says. The employees were also required to change into their uniforms before clocking in, and clock out before changing again at the end of the day, according to the complaint.

The two named Plaintiffs are seeking to represent a class of an estimated 150 current and former non-exempt W Hollywood employees who have worked for the hotel within the past four years. Their suit seeks damages for unpaid minimum and overtime wages, along with punitive damages, attorneys’ fees and court costs.  No trial date has been set by the court.
