Home Health Ohio Overtime Lawsuit Against Maxim Healthcare Services

TOLEDO, Ohio. — A class action lawsuit was filed in October, 2012 on behalf of healthcare workers being cheated out of overtime by home healthcare company, Maxim Healthcare Services. The plaintiffs worked approximately 70 hours per week, but were never paid overtime wages.  Under the law, the company was required to pay workers 1.5 times their hourly wage. 

The lawsuit also that Maxim knowingly and willfully committed wage theft against all of its hourly employees by misclassifying them as exempt from the FLSA’s overtime requirements.  The case alleges that the company intentionally used the wrong classification in order to avoid paying for overtime work.  The lawsuit is currently pending in the U.S. District Court, Northern District of Ohio, but the attorneys are already interviewing healthcare workers from across the country.
