Former California-Coca Cola Distribution Worker Files Unpaid Overtime Lawsuit

LOS ANGELES — A former warehouse distribution worker for a California-Coca Cola distributor recently filed an unpaid overtime lawsuit against the soft drink company alleging he and other employees at the American Canyon facility did not receive full compensation for all their hours worked. The complaint alleges that several violations under California labor and wage laws and seeks a trial by jury to recover back pay with interest, wages of unpaid meal breaks, and other damages as compensation for the alleged wage theft.

The class action unpaid overtime lawsuit, filed in in Napa County Superior Court, states the defendant failed to pay the long time worker all his due wages due to the payroll system rounding down to 15-minute increments. Furthermore, the complaint adds the defendant failed to provide the plaintiff and other distribution workers an uninterrupted 30-minute meal break immediately after five hours on the job.

Workers Claim Coca-Cola Failed to Provide Second Meal Break

Additionally, California labor and wage laws require employers provide a second 30-minute rest break to employees working more than 10 hours in a single shift, another violation the complaint alleges the defendant committed. Under state law, if employees are not provided these uninterrupted meal breaks, the worker must be compensated with an additional hour of regular hourly page to make up for the break. State and federal laws require employees be paid one and a half times their average hourly pay rate for overtime wages and be given accurate wage statements each week detailing all the hours worked and wages and benefits earned during that time.

The overtime lawsuit seeks class action status to allow other similarly affected workers to join the claim and recover their own unpaid overtime. The complaint asks for back pay with interest, liquidated damages equal to unpaid income, attorney’s fees, court costs and any other compensation the court may see fit to award the plaintiffs. The named plaintiff in this case may be entitled to additional compensation for taking the initiative and inherent risk of initiating the claim.
