LOUISVILLE — A lawsuit was filed on September 10, 2015 against ResCare Inc. by our class action overtime lawyers alleging that the company failed to properly compensate its hourly employees in violation of the federal Fair Labor Standards Act. Specifically, the lawsuit alleges that ResCare miscalculated its hourly employee overtime wages for hours in excess of 40 hours per week and also improperly awarded employees with paid time off in lieu of overtime at a rate that was less than their regular hourly rate. The case is currently pending in the U.S. District Court for the Western District of Kentucky.
