My wife is a RN at INOVA Fair Oaks. While she is paid based upon an hourly rate she is considered exempt. She routinely work 50-65 hours weekly but is only compensated for 40 hours. My wife is also in Stage One Kidney failure and under FMLA protections. When her illness requires she misses work by being late or absent. In both cases she is docked any time missed. INOVA can't have it both ways, they can't say she exempt when it comes to overtime payment, then dock her a couple hours when sick, Correct?
