On May 16, 2014, our overtime pay lawyers filed a class action complaint against call center giant Convergys on behalf of customer service representative employees claiming to have not received wage and overtime compensation in violation of the Fair Labor Standards Act (“FLSA”) and state law.   Call center employees and customer service reps are often required to do work beyond a forty hour week and not paid overtime wages.  These actions can give rise to an unpaid overtime lawsuit.

In Matthews v Convergys, the plaintiffs assert the company intentionally failed to pay its home-based call center employees for time spent each day loading up their complex computer and phone systems, time they spent working on their unpaid lunch breaks, and time spent shutting their computers down – tasks for which the U.S. Department of Labor has declared call center employees are to be compensated. Convergys employs home-based call center employees in 35 different states. The lawsuit is currently pending in the U.S. District Court for the Western District of North Carolina.]]></description>

					<description><![CDATA[I worked for Convergys and have constantly complained about my pay check not showing my overtime, not the time I spent logging in, even if there was a system issue, that prevented me from logging in attributed to by their  (Convergys) equipment.  Also, my paycheck has never seemed to show the monies promised for certain promotions offered by Convergys, for performance or upselling products.]]></description>

					<description><![CDATA[i just wan to ask if it is possible to file a lawsuit for not getting my final pay on time.. For the final pay process it should only take 30-45 calendar days as written on form their provided me when i processed my clearance.. and it&#039;s almost three months now and my final pay is still not available. I&#039;ve been going back and forth to their company and it&#039;s costing me time, energy and money.. can you please give me  reply with this.? i really feel frustrated with their process]]></description>

					<description><![CDATA[I quit my employment with Convergys in October 2013. I quit because after complaining for months that my points were not correct, my overtime was paid at a rate that was a few cents above my hourly pay rate instead if 1.5 times and it happened on at least three pay periods that I have found. In January, Convergys sent me a final pay of $22 after I let them know they owed me about $300 after fixing all of my time card fix requests from April 2013 - September 2013. Some of the back pay was approved by an HR rep after I quit yet that amount was not included in the final pay. There are amounts owed that were tied to points and because they refused to acknowledge that the points were in error they basically said they did not owe me for that time when they could pull their records and see that I was at work taking calls yet their system showed that I was not there. I spoke with the same HR rep today who approved my back pay and she informed me after sending about 50 pages of documentation that they were no longer able to pull the records from a year ago and I need to prove days I said I was actually working, I am not going to go through that. I feel they also owe me for tuition reimbursement as I filed the paperwork in a timely manner and two team leads failed to sign off on it and forward it to an OM for signature and approval. They are actively trying to negotiate but because I cannot fully prove what they are wanting me to prove with the information I have, I would still lose out on money I earned so I am seeking help elsewhere.]]></description>
